NACADA: Bars Located Near Educational Institutions To Be Closed.

A national crackdown on bars and alcohol dispensing outlets close to educational facilities has been declared by NACADA, the National Authority for the Campaign Against Alcohol and Drug Abuse.

The Alcoholic Drinks Control Act of 2010 is the foundation for this initiative. Section 12(1)(c) of the Act mandates that facilities serving individuals under the age of eighteen must be situated at least 300 meters away from nurseries, primary, secondary, or any other type of educational institution.

Working along with pertinent national, and local government organizations, the crackdown will make sure that the positions taken by these outlets adhere to the law.

The Act’s sanctions, which include a fine of up to 500,000 shillings, up to three years in jail, or both, will apply to those who disobey this order.

Less than a week has passed since NACADA issued an order to remove alcohol-related billboards from locations close to educational institutions across the nation.

The trend persists in spite of laws that forbid deceptive, misleading, or likely to create false impressions advertisements about the qualities, health effects, health hazards, or social implications of alcoholic beverages, according to a statement released by the Authority on Monday.

The guidelines of the Alcoholic Drinks Promotion Regulations and the 2010 Alcoholic Drinks Control Act both require the removal of advertisements.

NACADA is actively working with appropriate parties at the national and local government levels to enforce the decision by overseeing the removal of any alcohol-related billboards that are located close to educational institutions.

Petitioners Challenge Muguka Ban In Coastal Counties

Mombasa, Kilifi, and Taita Taveta are the three counties that last week outlawed the use, sale, and entry of muguka and related products.

A petition for the prohibition of the sale and consumption of muguka has been filed against three counties.

According to Peter Odhiambo Agoro and Michael Mutembe Makarina, the reason muguka is lawful in the nation is because it isn’t seen as a drug.

They contend that NACADA has neither outlawed nor classified mugka as a narcotic, and that both mugka and miraa are recognized as legal crops in Kenya under the 2021 Miraa Regulations.

The two businessmen claim that there was no public involvement and that the national government alone has the authority to outlaw a product or service that is protected by a parliamentary statute.

The two also contend that county governments cannot decide to impose a ban without first deciding to regulate to have the legal processes in place.

Now, the two want the prohibition to be ruled unlawful and unconstitutional by the court.

Additionally, they ask the court to prevent the three county administrations from carrying out the aforementioned ruling.

US Embassy Engineer Dies in Kiambu Nightclub Fight Over Women

An American Embassy engineer was shot and killed after a brawl outside a popular Kiambu night club on Saturday night. The fight started with accusations by groups that one another was wooing their ladies.

Court documents that describe the horrific Saturday night event that claimed the life of Anthony Njomo Kiuno, 35, indicate this.

Joseph Njenga and Nason Kiteme are identified as the first and second respondents in the court documents.

It is alleged that on Saturday, a dispute over ladies turned violent between two groups of people out for a fun-filled night.

“The first respondent was at Quick-in Lounge promoting the music of one musician John Njagi with others when a misunderstanding between the second respondent and his party arose. A fight between the two parties started, where the group of the first respondent and the second respondent disagreed about each group accusing the other on seducing their women.” a DCI officer investigating the murder told the Kiambu law courts.

It is reported that during the altercation outside the nightclub, one of the groups was protected by armed security.

Investigations reveal that the shooting victim was not part of the ruckus.

The two suspects will be placed on remand for a period of ten days as detectives look into the murder.

The alleged shooter is still at large and is the target of detectives’ ongoing investigations.

The Quick-in Lounge, the location of the alleged incident, informed the media in a statement on Sunday that police were now looking into the event after receiving access to CCTV footage.

BCLB Orders Betting Companies To Transition To New System And Renew Licenses

For the fiscal year 2024–2025, gaming companies and betting shops may now submit applications to renew their licenses.

On Wednesday, the Betting Control and Licensing Board (BCLB) urged all operators to adhere to the new gaming management system even while it continues to be rolled out.

According to the Board, this automation will streamline the Kenya Revenue Authority’s (KRA) revenue collection process in compliance with a government order.

BCLB instructed all betting companies to quickly switch to the new gaming management system at a stakeholder engagement, with an emphasis on compliance.

“We have been doing applications and processes manually for years but now the time has come when we need to automate our processes. So in terms of moving forward we require that our operators process their applications through the online system which is the gaming management system.” BCLB CEO Peter Mbugi said.

The order is being issued in the wake of claims that just 97 of the 180 licensed operators have linked their systems with KRA to allow for real-time industry monitoring. The goal of this integration is to improve regulatory control at KRA and stop revenue leaks.

The licensing renewal process for the fiscal year 2024–2025 has also been started by the regulatory body for sports betting. This occurs concurrently with the board putting crucial adjustments into place to expedite activities in the gaming sector.
